The SEND Code of practice 0-25 states that all Local Authorities must make SEND Mediation and Disagreement Resolution Services (DRS) available to parents and young people. Whilst Local Authorities commission the service, it must be independent of the local authority. That means no-one who is directly employed by the local authority can provide Mediation & DRS services.
It is also important to note that the SEND Code of practice requires parents, carers and young people to consider Mediation before making a claim to the First Tier SEND Tribunal.
Oldham Local Authority has commissioned POINT to deliver Mediation and DRS in Oldham and all Mediation and Disagreement Resolution meetings are undertaken by a mediator trained to Civil Mediation Council Standards.
