Local Authorities and other bodies covered by the SEND Code of Practice 0-25 have a duty to maintain and review EHC Plans.

As a parent, carer or young person it is important to note that the code specifies that any reviews of an EHC Plan:

  • Must be undertaken in partnership with the child and their parent; or the young person.
  • Must take account of your views, wishes and feelings.

There are also specific duties that need to be undertaken when transferring an EHC plan (For example where a child or young person moves from one Local Authority to another).
